We love working with you and respect your privacy. This Privacy Policy tells you how we use your information and how we collect your information offline or online through our website: www.benitabensch.com (Site) and other related third-party platforms that we use.
The terms “we”, “us” or “our” mean Benita Bensch, ABN 80 475 746 001.
The types of personal information we may collect about you include:
your name, images, and complete contact details;
your age and/or date of birth;
your credit card or payment details;
responses to our client intake or reflection questionnaires, and notes and progress information we record in connection with coaching sessions;
where you choose to access an optional add-on service such as a human design report or consultation, your birth details (place, date and time of birth);
any customer survey results and customer service history;
information about your access and use of our Site;
additional personal information that you provide to us; and
any other personal information requested by us and/or provided by you or a third party such as Google or our third-party payment processor.
We may collect personal information directly from you — for example, when you contact us, complete a form or questionnaire, purchase or enquire about our coaching services, subscribe to our communications, or interact with our Site.
We may also collect personal information about you indirectly from third parties, such as our payment processor, analytics and marketing providers (including Google), and, where applicable, a sponsoring organisation that arranges coaching for you.
Where it is reasonable and practicable to do so, we will collect personal information directly from you.
We may collect, hold, use and disclose personal information for the following purposes:
to enable you to access and use our Site;
to provide our coaching services and programs to you;
to contact and communicate with you;
for internal record keeping, administrative purposes, invoicing, and billing purposes;
for analytics, market research and business development;
for advertising and marketing;
to comply with our legal obligations and resolve any disputes that we may have; and
to consider an employment application.
We may disclose personal information to:
third-party service providers for the purpose of enabling them to provide their services;
our employees and contractors;
our existing or potential agents or business partners;
where you are receiving coaching arranged and paid for by your employer or another sponsoring organisation, that organisation — but only to confirm your attendance and completion of sessions, or to share high-level, de-identified themes with your informed consent; we do not disclose the content of your coaching sessions to a sponsoring organisation without your consent;
anyone to whom our business or assets (or any part of them) are, or may (in good faith) be, transferred;
credit reporting agencies, courts, tribunals, and regulatory authorities, in the event you fail to pay for goods or services we have provided to you;
courts, tribunals, regulatory authorities, and law enforcement officers, as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights;
third parties, including agents or sub-contractors, who assist us in providing information, products, services, or direct marketing to you. This may include parties located, or that store data, outside of Australia; and
third parties to collect and process data, such as Google Analytics or other relevant businesses. This may include parties that store data outside of Australia.
Some of the third parties described above are located overseas, or store data overseas. Where we disclose your personal information to an overseas recipient, we will take such steps as are reasonable in the circumstances to ensure the recipient does not breach the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) (Act), unless an exception applies. We expressly inform you that, if you consent to the disclosure of your personal information to a particular overseas recipient, APP 8.1 will not apply to that disclosure, meaning we will not be required to take those reasonable steps and we may not be accountable under the Act for how that recipient handles your information, and the Act and the APPs may not apply to that recipient. By providing us with your personal information and consenting to its disclosure overseas on this basis, you acknowledge and agree to the above.
Before any disclosure of your personal information to an overseas recipient on the basis of your consent, we expressly inform you that, if you consent, subclause 8.1 of APP 8 will not apply to that disclosure. This means that we will not be required to take reasonable steps to ensure the overseas recipient handles your personal information in accordance with the APPs, we will not be accountable under the Privacy Act 1988 (Cth) in respect of that recipient’s handling of your information, and you may not be able to seek redress under the Act if the recipient mishandles your information. If you do not wish to provide this consent, please contact our Privacy Officer using the details below; however, we may then be unable to provide some products or services that depend on overseas disclosure.
With some clients, we offer the option of a referral to an external practitioner for a related service, such as a human design report or consultation. If you choose to access this kind of service, we will only share the personal information necessary for that purpose (including any birth details you provide) with the relevant practitioner with your prior consent. That practitioner’s handling of your information is governed by their own privacy practices, not this Privacy Policy, and we are not responsible for it.
Information classified as “sensitive information” has a higher level of protection under the APPs.
Sensitive information means information relating to your racial or ethnic origin, political opinions, religion, trade union or other professional associations or memberships, philosophical beliefs, sexual orientation or practices, criminal records, health information or biometric information. Provided you consent, your sensitive information (if we hold any) may only be used and disclosed for purposes relating to the primary purpose for which the sensitive information was collected or if required or authorised by law.
In the course of coaching, you may choose to share health-related or other sensitive information with us. We only use this information to provide coaching to you, and do not disclose it to any third party (including a sponsoring organisation, if applicable) without your consent, except as otherwise described in this Privacy Policy or required by law.
Choice and consent: By providing personal information to us, you consent to us collecting, holding, using, and disclosing your personal information in accordance with this Privacy Policy. You do not have to provide personal information to us, however, if you do not, it may affect your use of this Site or the products and/or services offered on or through it.
Information from third parties: If we receive personal information about you from a third party, we will protect it as set out in this Privacy Policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.
Restrict: If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by contacting us using the details below.
Access: You may request details of the personal information that we hold about you. An administrative fee may be payable for the provision of such information.
Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant, or misleading, please contact us using the details below. We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading, or out of date.
Complaints: If you wish to make a complaint about how we have handled your personal information, please contact us using the details below and provide us with full details of the complaint. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take to deal with your complaint.
Unsubscribe: To unsubscribe from our e-mail database or opt-out of communications (including marketing communications), please contact us using the details below or opt-out using the opt-out facilities provided in the communication.
Your personal information may be transferred to, or stored in, an overseas jurisdiction, which may include the United States of America, the United Kingdom, or countries within the European Union (EU). Data protection laws in these countries may differ from those in Australia and may not provide the same level of protection as the APPs. Except where you have consented to the disclosure on the basis described above (in which case APP 8.1 does not apply), we will take such steps as are reasonable in the circumstances to ensure that overseas recipients do not breach the APPs in relation to your personal information. You acknowledge that, where APP 8.1 applies, an act or practice of an overseas recipient that would breach the APPs may be taken under the Act to have been done by us.
In some circumstances, the European Union General Data Protection Regulation (GDPR) provides additional protection to individuals located in Europe. Where this is the case, there may be additional rights and remedies available to you under the GDPR if your personal information is handled in a manner inconsistent with that law.
We do not currently use your personal information in any computer program to make, or do a thing that is substantially and directly related to making, a decision that could reasonably be expected to significantly affect your rights or interests. If this changes, we will update this Privacy Policy to describe that use before it occurs, consistent with our obligations under the Privacy Act 1988 (Cth), including the automated decision-making transparency requirements commencing 10 December 2026.
We are committed to ensuring that the personal information we collect is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the personal information and protect it from misuse, interference, loss and unauthorised access, modification, and disclosure.
We cannot guarantee the security of any information that is transmitted to or by us over the Internet. The transmission and exchange of information is carried out at your own risk. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that the personal information we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.
We maintain procedures to detect, assess and respond to data breaches. If we have reasonable grounds to believe that an eligible data breach has occurred — that is, unauthorised access to, unauthorised disclosure of, or loss of personal information we hold that is likely to result in serious harm to any affected individual, and we have been unable to prevent that likely risk of serious harm through remedial action — we will notify the affected individuals and the Office of the Australian Information Commissioner as soon as practicable, in accordance with the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act 1988 (Cth).
We retain personal information only for as long as is reasonably necessary for the purposes described in this Privacy Policy, or for as long as we are required to retain it to comply with our legal, accounting or reporting obligations. Where we no longer need your personal information for any purpose for which it may be used or disclosed, and we are not required by law or a court or tribunal order to retain it, we will take such steps as are reasonable in the circumstances to destroy the information or ensure that it is de-identified.
Our coaching services and programs are available only to adults aged 18 or over. Our Site is directed to adults, and anyone under 18 may only use it with the consent and supervision of a parent or guardian. We do not knowingly collect personal information from children under 18. If you believe that we have inadvertently collected personal information from a child, please contact our Privacy Officer using the details below and we will take reasonable steps to delete that information.
